&lt;p&gt;The 65th Commencement Exercises, May 10-11, 2013 Franciscan University of Steubenville’s baccalaureate and commencement speakers exhorted graduates of the Class of 2013 to share the good news of Jesus Christ, to accept new challenges, and to use their education to make a difference in society. Also during the weekend celebrations, Father Terence Henry, TOR, was honored for his 13 years of service as Franciscan University’s president. With 708 graduates from 40 undergraduate and 7 master’s programs, the Class of 2013 was the University’s second-largest graduating class ever. Humphrey Building 200 Independence Avenue, SW Washington, DC 20201  Re: Notice of Proposed Rulemaking on Preventive Services File Code No. CMS-9968-P  Dear Sir or Madam: Franciscan University of Steubenville finds the U.S. Department of Health and Human Services’ current proposed revision to the HHS mandate unsatisfactory for several reasons.  The newest proposed regulation continues to uphold mandated coverage of abortion-inducing drugs, contraceptives, and sterilization procedures. Because it remains unchanged, Franciscan University stands with the U.S. Conference of Catholic Bishops (USCCB) in believing that even apart from the religious liberty issues it creates, the HHS mandate should be rescinded.  The USCCB public comment on the NPRM points out the increased serious health risks associated with contraceptives and sterilization and finds the contraceptive mandate “at war” with the federal government’s aim to ensure coverage of services that prevent disease. The bishops’ statement also notes that by requiring the coverage of abortifacient drugs and devices, the mandate also violates several provisions of the Affordable Care Act as well as “the Administration’s own public assurances that ACA does not require abortion coverage” (Public Comment Re: Notice of Proposed Rulemaking on Preventive Services File Code No. CMMS-9968-P, March 20, 2013, Section I).  As a faithfully Catholic university, Franciscan University cannot offer the mandated coverage in its employee health plan without violating Catholic Church teaching on the sanctity of human life and the purpose of marriage. Unfortunately, the latest so-called accommodation still deprives Franciscan University and our faculty and staff of our right to a health plan consistent with our religious beliefs. Far from alleviating our serious moral problem with the HHS mandate, it would force us to play a key role in facilitating contraceptive coverage. Also, despite its “cost-neutral” assumption, it would likely still mean some payment by the University for these objectionable services. This is essentially no different than directly providing such coverage in our employee healthcare plan. The February 1 proposal would require Franciscan University’s simple act of contracting with an insurer to trigger automatic coverage by that insurer for every pill and procedure that we, as a Catholic university, find morally objectionable. Further, our employees cannot opt out of this automatic coverage, even when it deeply offends their religious beliefs.  Thus, the proposed regulation will deny Franciscan University the freedom to exclude items that violate Church teaching and the consciences of our employees, the majority of whom choose to work at Franciscan specifically because of our faithfulness to the Catholic Church.  Franciscan University must also protest the proposed regulation’s refusal to exempt or accommodate the numerous conscientiously objecting individuals, for-profit or non-profit employers, insurers, and third-party administrators. Franciscan University has heard from alumni business owners and individuals who integrate their religious faith into their business practices and daily life and now find their heartfelt values dismissed out of hand by the HHS mandate’s contraceptive requirements.  Even with the most recent proposed changes, the HHS mandate continues to be an unprecedented violation of our religious liberty, and violates the First Amendment, Religious Freedom Restoration Act, and the Administrative Procedure Act. It also seeks to redefine religious liberty by narrowly and wrongly restricting freedom of religion to freedom of worship. Franciscan University asks that the Obama administration protect our rights of conscience and religious liberty as a Catholic institution—and, indeed, the rights of all Americans—instead of picking and choosing whose exercise of religion is protected and whose is not. We ask that it return to the long tradition in federal law of generous protection for moral or religious objectors, and restore our First Amendment right to religious liberty. If not, Franciscan University will have no choice but to continue our fight to live the faith we believe.  As a Catholic university, Franciscan University not only has a responsibility to teach what the Church teaches about the dignity of human life and the right to life from conception to natural death, we must live out that teaching to the best of our ability. We cannot and will not allow the HHS mandate to compromise our witness and our Catholic educational mission. Franciscan University will therefore continue to seek redress in the courts for this grave injustice for as long as needed to restore First Amendment rights to their rightful place of honor in law and in the lives of U.S. citizens.
